Terms of Service
Jackelynn Noel Photography – Client Gallery & Online Services

These Terms of Service (“Terms”) govern your use of any online galleries, websites, and services provided by Jackelynn Noel Photography (“we,” “us,” “our”), including galleries hosted on Pixieset and any related services, downloads, or purchases (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Services.
1. Use of the Services
1.1 Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Services. By using the Services, you represent that you meet these requirements.
1.2 Account & Access
Some galleries may be password-protected or require a unique link. You are responsible for maintaining the confidentiality of any password or link provided to you and for all activity that occurs under your access.
1.3 Permitted Use
You may use the online gallery and Services only for:
Viewing your images
Selecting favorites
Downloading images (if enabled)
Ordering prints or products (if enabled)
You may not use the Services for any unlawful purpose or in a way that infringes on the rights of others.
2. Copyright & Image Usage
2.1 Ownership
Unless otherwise agreed in writing, all images are copyrighted and owned by Jackelynn Noel Photography. You are purchasing a license to use images, not the copyright itself.
2.2 Personal Use License
For most portrait/family sessions, you are granted a non-exclusive, non-transferable license to:
Download and store images for personal use
Print images for personal use
Share images on personal social media accounts (with credit to @jackelynnnoelphotography where reasonable)
You may not:
Sell the images
Use the images for commercial purposes, advertising, or editorial use unless you have written permission and/or a separate commercial license
Alter the images with heavy edits, filters, or AI tools that significantly change the original style, unless expressly permitted
2.3 Commercial & Business Use
For headshots, branding, or commercial sessions, usage rights are governed by the specific agreement or invoice terms. If you are unsure about your usage rights, please contact us at hello@jackelynnnoelphotography.com.
2.4 Model Release (If Applicable)
Unless otherwise stated in your contract, you may be asked to grant permission for Jackelynn Noel Photography to use images from your session for portfolio, website, and marketing purposes. This is typically handled via a model release in your booking agreement or session form. If you have questions or wish to discuss limitations, please email hello@jackelynnnoelphotography.com.
3. Online Galleries, Downloads & Expiration
3.1 Gallery Availability
Online galleries are hosted through Pixieset or a similar third-party service. Galleries are available for a limited time (for example, a set number of weeks after delivery). The specific expiration window will be shared in your delivery email.
3.2 Gallery Expiration
Once a gallery expires, it may be archived or removed. While we do our best to maintain backups, we cannot guarantee indefinite storage of your images. It is your responsibility to:
Download your images
Back them up safely in multiple locations
3.3 Downloads & Files
When downloads are enabled:
Digital files are typically delivered in JPG format in high resolution suitable for printing (unless otherwise specified).
You are responsible for having appropriate devices/software to open and store the files.
4. Orders, Payments & Refunds
4.1 Prints and Products
Prints, albums, and products ordered through the online gallery are produced by professional labs and/or third-party vendors. Please carefully review your order before checkout. Orders are generally final and non-refundable once placed, except in cases of damage or error.
4.2 Digital Products
Digital images and digital products are considered delivered once the download link has been provided. Due to the nature of digital goods, all digital sales are final.
4.3 Issues with Orders
If there is an issue with your order (e.g., damage, printing error), please contact us within 7 days of receiving the product at hello@jackelynnnoelphotography.com with your order details and photos of any defects.
5. Rescheduling, Cancellations & Force Majeure
Rescheduling, cancellation, and retainer policies are generally covered in your session contract or photography agreement. In the event of illness, weather issues, or events outside of either party’s control (force majeure), we will work with you to reschedule or otherwise make reasonable accommodations as outlined in your contract.
6. Third-Party Services (Including Pixieset)
Our galleries and some services are provided via Pixieset and possibly other third-party platforms. By using the Services, you also agree to be bound by any applicable third-party terms and privacy policies.
We are not responsible for outages, data loss, or issues caused by third-party platforms, but we will make reasonable efforts to assist if you experience problems accessing your gallery.
7. Limitation of Liability
To the fullest extent permitted by law, Jackelynn Noel Photography is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or related to your use of the Services or images.
Our total liability for any claim related to the Services will be limited to the amount you paid for the specific session or product giving rise to the claim.
8. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
